HAVING A NAME IS YOUR HUMAN RIGHT: I just found out that according to Article 7 of the UN Convention on the Rights of the Child, children "shall have the right from birth to a name."

Was that right included in the Charter in response to an epidemic of nameless births? I didn't have a name until I was eight days old, but I don't hold it against my parents.

In the future, if society decided that it is more efficient for humans to have a number instead of a name, would that violate the Charter? Or does a string of digits count as a name? Calling prisoner 24601...

The Charter also says in Article 16 that "No child shall be subjected to...unlawful attacks on his or her honour and reputation." What does that mean? Were all those mean kids who called me fat when I was little violating my human rights?

There are plenty of good and useful rights in the Charter, but some pruning might have been beneficial.

Article 14. 1. States Parties shall respect the right of the child to freedom of thought, conscience and religion.

Yeah, try telling that to my parents Sunday morning when it's time to go to church.

Well, since none of them were going to be enforced, it must have seemed pointless to worry about it.

In some parts of rural China, it was traditional not to name your daughters, but to assign them a number : 'Number Two Daughter' etc.

You could argue that gender inequality was powerfully reinforced here by the denial of a mark of individuality to female children but not to male: thus reinforcing the special cultural status of male children. Having your own first name is, of course, the first thing that marks you out to others as an individual, distinct from the family/clan you belong to, and capable of independent survival.

You could argue that being in the Charter does nothing to secure these rights for anyone, but I think the idea that every child deserves a name is a genuinely worthwhile principle.

What!? A child with no name? Wouldn't he or she be anonymous?

I think Article 16 is supposed to mean that the UN considers extorting sex from children to be a lawful attack on their honor.

I believe that it has been litigated in the U.S. and it is not lawful to name-number your child, i.e. you cannot call your child "24". As such, it is enforceable.

I believe (i..e subject to finding out the contrary) that the origin of the Charter rights on reputation are rooted in understandings from Jewish law. The general logic might be that one person can take away a reputation, unlawfully, but cannot restore it. Given that, it ends up at the top of the list, and on the UNDHR, called "fundamental".

Reputation "rights" often perplexes commentators. I don't know of any documents that give what might be the 'legislative history' for the UNDHR, provision by provision, from which people might trace the origins of various pieces of thought.

I would suggest that Blair's evasiveness is more related to the political situation in the UK.

A child withh noname?? Wouldn't he or she be anonymous???????
